Unlimited Civil Action
No.: SCUK CVPT 0289022
NOTICE OF APPEAL |
To the Clerk of
the Superior Court:
Please Take Notice that Petitioners
CAMPAIGN TO RESTORE JACKSON STATE
REDWOOD FOREST, DHARMA CLOUD CHARITABLE FOUNDATION TRUST, and FORESTS
FOREVER FOUNDATION hereby appeal from the
judgment entered on September 23, 2003. Petitioners appeal from that
portion of the judgment that refused to enjoin any logging in Jackson
Demonstration State Forest under either the 1983 management plan or the
new management plan, and from that portion refusing to consider
Petitioners’ argument that the forest inventory was not properly
described and considered in the EIR.
Petitioners do not appeal from that portion of the judgment (1)
determining that the judgment is in favor of Petitioners, (2) that a
peremptory writ of mandate should issue directing Respondent to set
aside its decision approving the updated management plan, (3) that
Respondent should comply with CEQA in any subsequent action to approve
the management plan, (4) that Respondent should make a return to the
writ, (5) that the court will maintain jurisdiction over the
proceedings, and (6) that Petitioners are the prevailing parties for
purposes of attorney fees.
